The terms "Macroscope" and "Gyroscope" are registered trademarks referring to the bodies of knowledge and methodology frameworks, including, without being limited to methods, processes, techniques, guidance, templates, examples, training material, tools and documentation, (collectively "Intellectual Property") exclusively owned by Fujitsu Consulting (Canada) Inc., a corporation incorporated under the laws of Canada, having offices at 110 Blvd Crémazie West, suite 800, Montreal Quebec Canada H2P 1B9 (hereinafter "Fujitsu").
The site http://demo.macroscope.ca.fujitsu.com and all sites whose address is in the form xxxxdemo.macroscope.ca.fujitsu.com (hereinafter "Macroscope Websites") are websites designed and operated by Fujitsu to promote, disseminate and use the Intellectual Property. The use of Macroscope Websites and their content is governed by the terms of the license agreement outlined below.
These Terms and Conditions ("Terms") are intended to define the terms and conditions for making Macroscope Websites available.
Access to and/or use of the Macroscope Websites implies acceptance and observance of all the terms and conditions of these Terms and their unconditional acceptance. All contents on the Macroscope Websites and all copyrights, trademarks and any other Intellectual Property rights related to the contents are owned by Fujitsu and you must always acknowledge the Intellectual property rights belong to Fujitsu and make sure Intellectual Property notice regarding confidentiality, ownership of trademarks and copyrights appears on all your utilization of the Macroscope Websites content.
III. Limitation of Use
Except to the extent expressly permitted by these Terms, or by applicable law, no contents on the Macroscope Websites may be used, copied, modified, translated, distributed or otherwise utilized without the prior permission of Fujitsu which consent may be withheld at Fujitsu's sole discretion. Fujitsu reserves the right to add, delete, or modify these Terms or the contents of the Macroscope Websites at any time without notice.
IV. Injunctive Relief
Upon any actual or threatened violation of these Terms by you, Fujitsu may be entitled to preliminary and other injunctive relief, in addition to any other rights, remedies and recourses that it may have at law or in equity. No failure or delay by Fujitsu in exercising any right, power or privilege hereunder shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise by Fujitsu thereof or the exercise of any right, power or privilege hereunder.
V. Disclaimers of Warranties
The contents on the Macroscope Websites are provided "as is" without warranties or conditions of any kind either express or implied (including, but not limited to, any implied warranty of merchantable quality, fitness for a particular purpose, title, or non-infringement of third parties' rights). Fujitsu does not warrant that the contents are error-free. Fujitsu will not update the Macroscope Websites during the Terms.
VI. Disclaimer of Links
Any direct or indirect reference to websites not operated by Fujitsu ("Linked Sites") or to a specific third party's product or service on the Website, is not a recommendation by Fujitsu. Fujitsu disclaims liabilities for access to and use of Linked Sites.
VII. Limitation of Liability
The Fujitsu Group is not liable for direct, indirect, incidental, consequential, punitive, or other damages (including, but not limited to, economic losses, lost profits, lost revenues, or lost data) arising out of the access to or inability to access to this Website, the Subsites or the Linked Sites, even if advised of the possibility of such damages.
VII. Transmitted Materials
Any materials, information, or ideas that you transmit to or post to the Macroscope Websites ("Transmitted Material") is deemed non-confidential and non-proprietary and Fujitsu has no obligations including without limitation confidentiality obligations in connection with the Transmitted Material.
IX. Linking to the Website
